2024年12月24日 ตาม พ ร บ คุ้มครองแรงงาน พ ศ 2541 มาตรา 30 ระบุว่า ลูกจ้างซึ่งทำงานติดต่อกันครบ 1 ปี มีสิทธิ์หยุดพักผ่อนประจำปีได้ ปีละไม่น้อยกว่า 6 วันทำงาน และนายจ้างต้องทำการจ่ายค่าจ้าง  ลูกจ้างมีสิทธิใช้วันหยุดพักผ่อนประจำปีตามกฎหมายเมื่อทำงานครบ 1 ปี หรือเข้าใจง่าย ๆ ก็คือ ลูกจ้างสามารถใช้สิทธิวันหยุดพักผ่อนประจำปีเมื่อทำงานเข้าสู่ปีที่ 2 ยกตัวอย่างเช่น นายนันทกรเข้าทำงานที่บริษัทแห่งหนึ่งใ  ลาพักร้อน แม้ชื่อจะขึ้นว่าเป็น วันลา แต่ในความเป็นจริงคือ วันหยุด และเมื่อทำงานครบ 1 ปี ลูกจ้างต้องได้รับวันหยุดอย่างน้อย 6 วันต่อปี ตามกฎหมาย นายจ้างสามารถกำหนดวันหยุดลาพักร้อนให้ลูกจ้างได้ และห  วันหยุดพักผ่อนประจำปี ลูกจ้างซึ่งทำงานติดต่อกันมาครบ 1 ปี มีสิทธิหยุดพักผ่อนประจำปีไม่น้อยกว่า ปีละ 6 วันทำงาน พ ร บ คุ้มครองแรงงานฯ มาตรา 30 กำหนดหลักเกณฑ์การหยุดพักผ่อนประจำปี โดยบัญญัติว่า ลูกจ้างซึ่งทำงานติดต่อกันมาแล้วครบ 1 ปี มีสิทธิหยุดพักผ่อนประจำปีได้ปีหนึ่งไม่น้อยกว่า 6 วันทำงาน โดยให้นายจ้างเป็นผู้
